Terms of Service

1. About Trendlyst

Trendlyst provides tools for working with supported Instagram content, including:

• Sorting posts and Reels
• Displaying content metrics
• Analyzing content and profiles
• Comparing saved profiles
• Exporting available metadata
• Downloading supported media
• Transcribing and translating videos
• Managing transcripts, credits and creator collections
• Adding optional video playback controls

Feature availability may depend on your plan, credit balance, browser, location, Instagram page and the data made available by Instagram.

Trendlyst is an independent service. It is not affiliated with, endorsed by or sponsored by Instagram, Meta or any other social media platform.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Trendlyst.

If you use Trendlyst on behalf of a company, agency or other organisation, you confirm that you have authority to accept these Terms on its behalf.

3. Accounts

Some features require a Trendlyst account.

You agree to:

• Provide accurate account information
• Keep access to your email account and devices secure
• Notify us promptly if you suspect unauthorised access
• Accept responsibility for activity performed through your account

You may not sell, transfer, share or sublicense your account, Pro access or credits without our written permission.

We may suspend access where we reasonably believe that an account has been compromised, shared improperly, used fraudulently or used in violation of these Terms.

4. Licence to Use Trendlyst

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive and non-transferable licence to install and use Trendlyst for lawful personal or internal business purposes.

This licence does not transfer ownership of Trendlyst or any part of the Service to you.

You may not:

• Copy, resell, rent, sublicense or redistribute Trendlyst
• Reverse engineer, decompile or attempt to extract source code, except where applicable law expressly permits it
• Circumvent Pro restrictions, credits, access controls or security measures
• Interfere with the operation or security of the Service
• Use automated methods to overload Trendlyst, Instagram or any third-party service
• Use Trendlyst to create a competing product using our confidential or proprietary technology
• Remove copyright, trademark or ownership notices
• Use the Service for unlawful, fraudulent, abusive or deceptive activity

5. Your Use of Instagram and Third-Party Content

Trendlyst helps you interact with content available through your active browser session. Trendlyst does not grant you ownership of Instagram content or permission to use content belonging to another person.

You are solely responsible for:

• Complying with Instagram's terms, policies and technical restrictions
• Ensuring that your use of downloaded, exported, transcribed or translated content is lawful
• Obtaining any necessary permission from content owners
• Respecting copyright, trademark, privacy, publicity and other rights
• Determining whether your intended use qualifies as research, commentary, fair dealing, fair use or another lawful exception
• Complying with data-protection and marketing laws applicable to your activities

You must not use Trendlyst to:

Download or distribute content without sufficient rights or permission; harass, stalk, identify or profile individuals unlawfully; collect sensitive personal information; facilitate spam, impersonation, fraud or deceptive marketing; evade platform restrictions or rate limits; access private content without authorisation; or infringe intellectual-property, privacy or publicity rights.

We do not review or approve your use of third-party content. You remain responsible for all content you collect, download, export, transcribe, translate, publish or distribute.

6. Content and Data Accuracy

Trendlyst processes information that may be provided by Instagram pages, browser responses and third-party services.

We do not guarantee that:

• All posts or Reels will be detected
• Every metric will be available
• Views, likes, comments or engagement values will be complete or current
• Captions, hashtags, locations, music or timestamps will always be available
• Transcripts or translations will be error-free
• Analytics will predict future performance
• Downloads will always complete successfully

You should independently verify information before relying on it for business, financial, legal, research or publishing decisions.

Trendlyst does not guarantee account growth, increased engagement, revenue, reach, followers or any other business result.

7. Free and Paid Features

Trendlyst may provide free features, paid plans, subscriptions, one-time purchases, credit packages or promotional access.

Feature limits and prices are displayed on the applicable pricing or checkout page and may change for future purchases.

Paid features may include:

• Explore and Saved sorting
• Advanced sorting and filtering
• Custom weight formulas
• Bulk selection
• Extended bulk downloads
• Transcription and translation access
• Other features identified as Pro

Certain features may require both Pro access and a sufficient credit balance.

8. Subscriptions

Where a monthly or yearly subscription is offered:

• The subscription automatically renews at the end of each billing period unless cancelled before renewal
• You authorise the payment provider to charge the applicable recurring fee and taxes
• Cancellation stops future renewals but does not ordinarily reverse charges already completed
• Access generally continues until the end of the paid billing period
• Failure to complete payment may result in restricted or suspended access

You can manage or cancel an active subscription using the account, billing or payment-management options made available to you.

9. Lifetime Access

Where Trendlyst offers a lifetime purchase, lifetime means access to the purchased features for the commercial lifetime of the relevant Trendlyst product, not the lifetime of the purchaser or any guaranteed minimum period.

Lifetime access:

• Is personal to the purchasing account
• Is not transferable unless we approve otherwise
• Does not guarantee that every future product, service or feature will be included
• May exclude usage-based services, third-party costs, transcription credits, translation credits or separately priced add-ons
• Remains subject to these Terms and acceptable-use restrictions

We may discontinue a feature or the Service where continued operation becomes commercially, legally or technically impractical.

10. Credits

Credits may be required for transcription, translation or other usage-based features.

Unless otherwise stated at purchase:

• Credits have no cash value
• Credits cannot be withdrawn, resold or transferred
• Credits may only be used with the account to which they were granted
• Credit usage may be calculated using media duration, minimum charges or another disclosed usage method
• Credits are deducted after or in connection with successful processing
• Promotional or bonus credits may have additional restrictions
• Credits lost through a violation of these Terms are not refundable

If a processing failure occurs before a usable result is generated, we may restore the affected credits where our records confirm that the charge was incorrect.

We may correct credit balances affected by technical errors, duplicate grants, chargebacks, refunds, abuse or fraudulent activity.

11. Payments, Taxes and Billing

Payments may be processed and sold through Dodo Payments or another authorised payment provider acting as a merchant of record or payment service provider.

Your purchase may also be subject to the payment provider's:

• Buyer terms
• Privacy policy
• Billing terms
• Tax treatment
• Chargeback and dispute procedures
• Refund rules

The payment provider may appear as the seller or billing descriptor on your receipt or financial statement.

You agree to provide accurate billing information and authorise the applicable charges displayed at checkout.

Prices may exclude or include taxes depending on your location and the checkout presentation.

We do not directly store your complete card or banking details.

12. Refunds

Except where required by applicable law or expressly stated at checkout, payments are non-refundable once access, credits or digital services have been delivered.

Refund eligibility may depend on:

• The payment provider's buyer and refund terms
• Whether the purchased service was delivered
• Whether credits have been used
• Whether substantial usage has already occurred
• Whether the request relates to a duplicate or unauthorised charge
• Applicable consumer-protection law

Before requesting a chargeback, contact us at akash@trendlyst.app so we can attempt to resolve the issue.

Abusive, fraudulent or bad-faith refund and chargeback activity may result in suspension of the associated account.

Nothing in these Terms removes consumer rights that cannot legally be waived.

13. Transcription and Translation

When you request transcription or translation, you authorise Trendlyst and its service providers to process the selected media, audio, metadata, transcript and translation inputs as necessary to complete the request.

You confirm that you have sufficient rights and authority to submit the selected content for processing.

Transcription and translation results may contain errors caused by:

• Audio quality
• Accents or pronunciation
• Multiple speakers
• Background noise or music
• Language detection
• Context, slang or specialised terminology
• Automated processing limitations

You must review results before publishing, quoting, relying on or distributing them.

Trendlyst must not be used to transcribe or translate unlawfully obtained private communications.

14. Downloads and Exports

Trendlyst may allow you to download media or export available metadata.

You are responsible for:

• Storage space on your device
• Reviewing downloaded files for accuracy
• Keeping exported data secure
• Ensuring that downloading and subsequent use are lawful
• Complying with any limits imposed by Instagram, your browser or your network

Large downloads may be divided into multiple archive files. Downloads may be delayed, interrupted or restricted because of browser limits, platform changes, network errors or rate limits.

15. Intellectual Property

Trendlyst, including its software, branding, interface, designs, documentation, website and original content, is owned by Akash Sahani or the applicable licensors and is protected by intellectual-property laws.

Trendlyst and associated branding may not be used without prior written permission.

Third-party names, trademarks, content and services remain the property of their respective owners.

16. Feedback

You may send us ideas, suggestions or feature requests.

By submitting feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free and unrestricted right to use, modify and incorporate that feedback into Trendlyst without compensation or obligation to you.

This does not give us ownership of your underlying third-party content.

17. Privacy

Our Privacy Policy explains how we collect, use, store and share information.

By using Trendlyst, you acknowledge that information will be processed as described in the Privacy Policy, including through third-party providers required for authentication, payments, transcription, translation, hosting and data storage.

18. Third-Party Services

Trendlyst depends on third-party platforms and providers, which may include Instagram, browser-extension platforms, hosting providers, databases, payment processors and artificial-intelligence services.

We do not control third-party services and are not responsible for:

• Their availability or performance
• Changes to their APIs, pages or policies
• Their suspension or termination of your account
• Their content or data practices
• Their independent acts or omissions

Your use of third-party services remains subject to their own terms and policies.

19. Service Changes and Availability

We may add, modify, limit, suspend or discontinue any part of Trendlyst.

This may be necessary because of:

• Instagram or browser changes
• Legal or compliance requirements
• Security risks
• Provider outages or pricing changes
• Abuse or excessive operational costs
• Product improvements or commercial decisions

We do not guarantee that the Service will always be available, uninterrupted, secure or compatible with every device or Instagram update.

Where practical, we may provide notice of significant changes, but urgent security or technical changes may occur without advance notice.

20. Updates

The browser extension may update automatically through the applicable extension store.

You agree that updates may:

• Add or remove features
• Fix security or compatibility issues
• Change technical requirements
• Modify the appearance or operation of the Service

Continued use after an update constitutes acceptance of the updated Service and any revised Terms then in effect.

21. Suspension and Termination

You may stop using Trendlyst at any time.

We may suspend or terminate your access where we reasonably believe that:

• You violated these Terms
• Your use creates legal, security or operational risk
• You attempted to evade payment, credits or access restrictions
• Your account is involved in fraud, abuse or unauthorised activity
• We are required to do so by law or a third-party provider
• The Service or relevant feature is discontinued

Where appropriate, we may give you an opportunity to resolve the issue.

Sections that by their nature should continue after termination, including payment obligations, intellectual property, disclaimers, limitation of liability, indemnity and dispute provisions, will remain in effect.

22. Disclaimer of Warranties

To the fullest extent permitted by law, Trendlyst is provided on an as is and as available basis.

We disclaim all express and implied warranties, including warranties of:

• Merchantability
• Fitness for a particular purpose
• Accuracy
• Availability
• Non-infringement
• Compatibility
• Uninterrupted or error-free operation

We do not warrant that Trendlyst will meet every requirement, remain compatible with Instagram or prevent all data loss, download failure, account restriction or business loss.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent legally permitted.

23. Limitation of Liability

To the fullest extent permitted by law, Akash Sahani and Trendlyst will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, including loss of:

• Revenue or profits
• Business opportunities
• Data or content
• Reputation or goodwill
• Account access
• Anticipated savings

This limitation applies whether the claim arises from contract, negligence, tort, statute or another legal theory, even if we were advised that the damage was possible.

To the fullest extent permitted by law, our total aggregate liability arising from or relating to Trendlyst will not exceed the greater of the amount you paid for Trendlyst during the 12 months immediately before the event giving rise to the claim or INR 5,000.

These limits do not apply where liability cannot legally be excluded or limited.

24. Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold harmless Akash Sahani and Trendlyst from claims, losses, liabilities, damages and reasonable expenses arising from:

• Your violation of these Terms
• Your unlawful use of Trendlyst
• Content you download, export, transcribe, translate or distribute
• Your infringement of another person's rights
• Your violation of Instagram's or another service's terms
• Fraudulent, abusive or unauthorised activity performed through your account

We reserve the right to control the defence of a claim covered by this section. You agree to reasonably cooperate with us.

25. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Before commencing formal proceedings, you agree to contact us and attempt in good faith to resolve the dispute informally for at least 30 days.

Subject to any mandatory consumer rights, courts located in Mumbai, Maharashtra, India will have exclusive jurisdiction over disputes arising from or related to these Terms or Trendlyst.

Nothing in this section prevents either party from seeking urgent injunctive or protective relief where necessary.

26. Changes to These Terms

We may update these Terms to reflect changes to:

• Trendlyst features
• Pricing or plans
• Service providers
• Legal requirements
• Security practices
• Business operations

The updated Terms will show a revised effective date.

For material changes, we may provide notice through the website, extension, dashboard or email.

Your continued use after revised Terms take effect means you accept the updated Terms. If you do not agree, you must stop using Trendlyst.

27. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign your rights or obligations under these Terms without our written permission. We may assign these Terms as part of a restructuring, financing, merger, acquisition or transfer of Trendlyst.

These Terms, together with the Privacy Policy and any terms displayed at checkout, constitute the entire agreement between you and Trendlyst regarding the Service.
